A RESOLUTION AUTHORIZING HON. ALLAN L. RELLON, DPA, PhD, CITY MAYOR, TO SIGN AND EXECUTE IN BEHALF OF THE CITY GOVERNMENT OF TAGUM THE DEED OF ABSOLUTE SALE OF A PARCEL OF LAND, REGISTERED IN THE NAME OF THE CITY GOVERNMENT OF TAGUM, LOCATED AT PUROK PANITAN, SAN ISIDRO, TAGUM CITY.

WHEREAS,  the City Government of Tagum had acquired a parcel of land with TCT No. 142-201-0504 with a total land area of 9,120 more or less located at Purok Panitan, San Isidro, Tagum City intended for resettlement and relocation site;

WHEREAS, a Contract to Sell was executed between the City Government and the beneficiaries involving their respective lot;

WHEREAS, a certification as issued by the City Accountant’s Office that the herein under beneficiaries have had fully paid their respective financial obligations with the City Government of Tagum, hence a Deed of Absolute Sale shall be executed to finally transfer the ownership of the lots as covered by this resolution;

WHEREAS, through Local Housing Board Resolution No. 7, series of 2017, the following ten (10) beneficiaries/applicants out of seventeen (17), have had complied with all the requirements set forth by the Local Housing Board – Technical Working Group and are certified member of the Panitan Urban Homeowners Association, Inc., to wit:

WHEREAS, this august body deems it proper to authorize the City Mayor to sign for and in behalf of the Local Government Unit of Tagum City, the Deed of Absolute Sale of a parcel of land, registered under the name of the City Government of Tagum, located at Purok Panitan, San Isidro, Tagum City, Davao del Norte;

NOW THEREFORE, be it resolved by the Sangguniang Panlungsod of Tagum to authorize the City Mayor to sign and execute in behalf of the City Government of Tagum the Deed of Absolute Sale of a parcel of land, registered in the name of the City Government of Tagum, located at Purok Panitan, San Isidro, Tagum City.

RESOLVED FURTHER, that the full text of the Deed of Absolute Sale shall be read as follows:

The CITY GOVERNMENT OF TAGUM, a public organization with office address at J.V. Ayala Avenue, Apokon, Tagum City, Philippines, represented in this act by its City Mayor, who is of legal age, Filipino, single/married and a resident of Tagum City, hereinafter known and referred to as the VENDOR.

_______________________________, of legal age, Filipino, single/married to __________________________ and a resident of Tagum City, Davao del Norte, Philippines hereinafter referred to as the VENDEE;

WITNESSETH: That

The VENDOR is the registered owner of a parcel of land situated in Purok Panitan, Brgy. San Isidro, Tagum City, Davao del Norte, which property is more particularly described as follows:

“A parcel of land Lot _______, Psd- __________, situated in Purok Panitan, Brgy. San Isidro, Tagum City, Davao del Norte, Island of Mindanao.

That on _________________, 20 ___, both parties entered into a Contract to Sell involving the above described parcel of land docketed as Doc. No.: ____ No.:_____ Series of 20 ____ of the Notarial Registry of Atty. _______________________.

That the full consideration of the property has been fully paid as stipulated in the said contract, hence, the execution of the Deed of Absolute Sale is now proper.

NOW THEREFORE, for and in consideration of the sum of ______________________________________________ PESOS, Philippine currency, receipt of which is hereby acknowledged from the VENDEE, to the entire satisfaction of the VENDOR, the latter hereby SELLS, CEDES, TRANSFERS and CONVEYS in a manner absolutely and irrevocably in favor of the VENDEE the property above-described, including the improvements existing thereon.
