A RESOLUTION AUTHORIZING HON. ALLAN L. RELLON, DPA, PhD., CITY MAYOR, TO ENTER INTO AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF TAGUM A SPECIFIC MEMORANDUM OF AGREEMENT WITH THE DEPARTMENT OF SOCIAL WELFARE AND DEVELOPMENT FIELD OFFICE XI, FOR THE IMPLEMENTATION AND DOWNLOADING OF FUNDS FOR SUPPLEMENTARY FEEDING PROGRAM INCENTIVES.

 

WHEREAS, a letter dated October 11, 2017 from the Office of the City Mayor, addressed to the Honorable Members of the Sanggunian, through Hon. Geterito T. Gementiza, MDMG, City Vice Mayor, duly received by the Office of the Secretary to the Sanggunian on October 18, 2017, with attached draft Specific Memorandum of Agreement between the City Government of Tagum and the Department of Social Welfare and Development Field Office XI, for the Implementation and Downloading of Funds for Supplementary Feeding Program Incentives, accordingly reviewed by the City Legal Officer, for appropriate action, was endorsed to the 7th City Council for First Reading on its 67th Regular Session on October 23, 2017;

WHEREAS, the measure was then referred to the Committee on Gender Equality and Development, Children and Family Welfare and Social Services and Committee on Laws, Rules and Privileges called for a meeting on October 25, 2017 at the SP Conference Room, 3rd Floor, New City Hall, Tagum City at 8:30 in the morning which was attended by Ms. Nora H. Lupiba, RSW, and Ms. Sally C. Balili, RSW, of City Social Welfare and Development Office;

WHEREAS, the City Government of Tagum is privileged to be identified as one of the first recipients to receive the Supplementary Feeding Program Incentives (SFPI) for its seven (7) years of implementation of the Supplementary Feeding Program and on time submission of reports and other requirements;

WHEREAS, after due deliberations, the Joint Committee recommended granting authority to the Local Chief Executive of Tagum City as signatory to the Specific Memorandum of Agreement relative to the implementation and downloading of funds for SFPI;

NOW THEREFORE, BE IT RESOLVED by the 7th City Council of Tagum to authorize Hon. Allan L. Rellon, DPA, PhD., City Mayor, to enter into and sign for and in behalf of the City Government of Tagum a Specific Memorandum of Agreement with the Department of Social Welfare and Development Field Office XI, for the Implementation and Downloading of Funds for Supplementary Feeding Program Incentives.

RESOLVED FURTHER, that the full text of the SPECIFIC MEMORANDUM OF AGREEMENT shall be as follows:

 

SPECIFIC MEMORANDUM OF AGREEMENT
FOR IMPLEMENTATION AND DOWNLOAD OF FUNDS FOR SUPPLEMENTARY
FEEDING PROGRAM (SFP) INCENTIVES

 

KNOW ALL MEN BY THESE PRESENTS:

This Specific Memorandum Agreement is made and entered by and between:

The Department of Social Welfare and Development (DSWD) with office address at Corner Suazo St. Ramon Magsaysay Avenue, Davao City, represented by its Regional Director, MERCEDITA P. JABAGAT, herein referred to as the “DSWD”;

-and-

The City Government of TAGUM, with office address at, Government Center, J.V. Ayala Avenue, Apokon, Tagum City, Davao del Norte, represented by its City Mayor, HON. ALLAN L. RELLON, DPA, PhD., herein referred to as the “LGU”;

 

WITNESSETH:

WHEREAS, this is a supplementary agreement to the Unified Memorandum of Agreement made and entered into on the 13th day of June 2017, by and between the Department of Social Welfare and Development F.O. XI (DSWD-FO XI) and the Local Government Unit (LGU) of Tagum City. It details the implementation arrangements for the Supplementary Feeding Program and Supervised Neighbourhood Play from C.Y 2015 to C.Y 2017-2018 in the locality.

NOW THEREFORE, for and in consideration of the foregoing premises, hereinafter set forth, the parties hereto agree to undertake the program under the following terms and conditions:

 

I.              ROLES AND RESPONSIBILITIES OF THE PARTIES

A.    The Department of Social Welfare and Development- Field Office XI

1.       Manage and coordinate/supervise the Regional implementation of the Supplementary Feeding Program project incentives;
2.       Designate a Focal Person for the Supplementary Feeding Program (SFP) to  provide guidance and technical assistance to the Local Government’s Offices, Day Care Worker (DCW) /Supervised Neighborhood Play (SNP) Workers, Day Care Workers Federation (DCWF), Local Supplementary Feeding Program (SFP) Focal Person and Local City Social Welfare & Development Officer (LCSWDO)  in the implementation of the program incentives prerequisites as stated in Section 5.4 of  Administrative Order No. 04, Series of 2016 which shall form part this agreement;
3.       Conduct orientation to the City Development Councils, Local Government Units (LGUs), Non-Government Organizations (NGOs) /People’s Organizations and other stakeholders on the objective, mechanics and their roles and responsibilities in the program;
4.       Release funds for Project Incentives to the City LGU SFP Focal/CSWDOs /DCWs in accordance with COA Circular Nos. 94-013 and 2007-001 dated December 13, 1994 and October 25, 2007 respectively;
5.       Closely monitor the incentives’ fund management, utilization, program implementation and respond to the operational concerns of the LGUs/DCWF/DCSPG/SNP-PG/DCW/SNP workers;
6.       Consolidate LGU and NGO report and submit physical accomplishment and financial report on the utilization of funds for the purpose.

B.    Local Government Unit (through the City Social Welfare and Development Office)

1.       Submit payroll of local qualified Day Care Workers/Teachers, designated Supplementary Feeding Program Focal Person and CSWDO, as basis for funding allocation and liquidation thereafter;
2.       Supervise the implementation of the Supplementary Feeding program in Day Care Centers/Supervised Neighborhood Play (DCC’s/SNP);
3.       Designate the City Social Welfare & Development Officer (CSWDO) and the SFP-program implementer as Focal Person for the feeding with the task of providing guidance, technical assistance, support and evaluation  of performance of  Day Care Workers/Child Development Centers (DCW’s/CDC) facility for Payroll for Incentives Inclusion;
4.       The Focal Person and the CSWDO shall be responsible for providing information for project incentives of the SFP. The CSWDO shall ensure that funds intended for the DCWs/SFP Focal/CSWDO shall be used solely for the purpose provided;
5.       Comply with the set reweighing deadline in the submission of all required documents such as master list of beneficiaries, baseline data of nutritional status as basis for funding allocation of incentives;
6.       Liquidate all funds transferred by DSWD-FO XI in accordance with COA Circular No. 94-013 dated December 13, 1994;
7.       Refund any unused funds to DSWD at the end of program implementation;
8.       Submit Fund Utilization Report every last Friday of the month and nutritional status upon entry and after sixty (60) and one hundred twenty (120) days of implementation of children beneficiaries to DSWD FO XI for consolidation;
9.       Update database of children beneficiaries of the program using Operation Timbang (OPT) Plus by City Nutrition Office;
10.   Conduct Parent Effectiveness Sessions (PES) for parents’ encouragement and motivation in nurturing their children.

 

II.            DISENGAGEMENT, TERMINATION FOR CAUSE AND SANCTIONS

The Local Government Unit may request termination of this Specific Implementation Agreement (SIA) and disengagement from the Supplementary Feeding Program (SFP) upon written notice to the other party specifying the reasons for the disengagement. The process of termination and disengagement shall follow SFP guidelines developed by the DSWD for the purpose.

Non-compliance or violation of either party to any of the provisions of this SIA, as determined by both parties after investigation, shall result in extrajudicial rescission of the same and/or the imposition of the following sanctions, depending on the gravity of the offense: (a) warning or imposition of probationary status; (b) termination of SFP implementation; and, (c) appropriate administrative and/ or criminal actions against responsible offices of the erring party.

III.           EFFECTIVITY AND AMENDMENTS

This agreement shall take effect upon signing of the parties and shall remain in full effect until the completion of all SFP implementation and/or the end of CY ______, unless otherwise revoked by any of the concerned parties.

Any modification on this Agreement will not be valid except when there is a written concurrence of BOTH PARTIES.
