 A RESOLUTION AUTHORIZING HON. ALLAN L. RELLON, DPA, PhD, CITY MAYOR, TO ENTER INTO AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF TAGUM A MEMORANDUM OF AGREEMENT (MOA) WITH THE ROAD BOARD, DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT (DILG) FOR THE ESTABLISHMENT OF THE PROVINCIAL AND CITY ROADS LOCATIONAL REFERENCING SYSTEM AND CONDUCT OF ROAD INVENTORY.

 

            WHEREAS, the Road Board ensures and overseas the optimum utilization of resources for the maintenance and improvement of a safe, efficient and environmentally balanced road network;

WHEREAS, the DILG, as one of its services, conducts a road inventory and condition Survey of city and provincial roads, as requested by the Road Board;

WHEREAS, the Project shall include among others the provision of Global Positioning System (GPS) road centerline and inventory data of all provincial and city roads which is important to guide the Road Board and the City Government of Tagum in planning, managing and prioritizing the maintenance of local roads in the area;

WHEREAS, the City Government of Tagum through the Project would be able also to increase its use of information technology to maintain an accurate inventory of its road networks;

            WHEREAS, this august body deems it proper to authorize the City Mayor to enter into a Memorandum of Agreement with the Road Board and the Department of the Interior and Local Government as the establishment of the Provincial and City Roads Locational Referencing System and conduct of Road Inventory would be beneficial to the city;

NOW THEREFORE, be it resolved by the Sangguniang Panlungsod of Tagum to authorize Hon. Allan L. Rellon, DPA, PhD, City Mayor to enter into and sign for and in behalf of the City Government of Tagum a Memorandum of Agreement (MOA) with the Road Board, Department of the Interior and Local Government (DILG) for the establishment of the provincial and city roads locational referencing system and conduct of roads inventory.

 

RESOVLED FURTHERMORE, that the full text of the Memorandum of Agreement shall be read as follows:

ESTABLISHMENT OF THE PROVINCIAL AND CITY ROADS

KNOW ALL MEN BY THES PRESENTS

 

The Memorandum of Agreement (MOA) entered into among:

 

The ROAD BOARD, a national government agency duly established and existing under Philippine laws, with office address at 2nd floor, Ave Maria Building, Quezon City Avenue corner Examiner Street, West Triangle, Quezon City, herein represented by its Executive Director, LUISITO V. CLAVANO, and hereinafter referred to as the “ROAD BOARD

– and –

The DEPARTMENT OF INTERIOR AND LOCAL GOVERNMENT, a national government agency duly established and existing under Philippine laws, with office address at 26th floor, DILG-NAPOLCOM Center, EDSA corner Quezon Avenue, Quezon City, herein represented by its Undersecretary for Local Government, AUSTERE A. PANADERO, and hereinafter referred to as the “DILG”;

– and –

The CITY OF TAGUM, a local government unit (LGU) in the Region XI, with address at J.V. Ayala Avenue, Barangay Apokon, Tagum City, represented by its City Mayor, HON. ALLAN L. RELLON, DPA, Ph.D., and hereinafter referred to as the “LGU”.

WITNESSETH

 

WHEREAS, Republic Act 8794 (the “Motor Vehicle Users Charge (MVUC) Law”) was enacted to provide for, and ensure, the adequate maintenance of national, provincial and city roads;

WHEREAS, the MVUC created a Road Board to oversee the management of the funds collected therefrom;

WHEREAS, the MVUC Law allocated five percent (5%) of its funds for the Special Local Road Fund (SLRF) which is apportioned for the maintenance of provincial and city roads on the basis of vehicle population and length of the network for locality;

WHEREAS, the Implementing Rules and Regulations of the MVUC Law and the Road Board Operations Manual requires the provision of data and information, and interpretation and approval of recommendations from professional services reports and investigations to assist the Road Board in the assessment of the conditions of local roads;

WHEREAS, a reliable local roads inventory is a vital mechanism, to guide the Road Bard and local government units in planning, managing and prioritizing the maintenance of local roads;

WHEREAS, there is a need to standardize the method and format in the conduct of an objective and comprehensive local roads inventory and condition survey;

WHEREAS, the DILG, through its SLRF-PMO, was requested by the Road Board to conduct a Road Inventory and condition survey for the 14,956.36 kilometers of city and 31,910.24 kilometers of provincial roads;

WHEREAS, the Road Board has approved the funding for the procurement of a service provider for the GPS centerline and local road inventory survey, training of LGUs in conducting future inventory updating, acquisition of survey equipment, and the fabrication of Kilometer Posts for a Location Referencing System (LRS);

WHEREAS, there is a need to ensure the effective implementation of the proposed project and the efficient utilization of the funds allocated therefor;

 

NOWTHEREFORE, for an in consideration of the foregoing premises, the parties have agreed as follows:

 

 

Article I
THE PROJECT

 

Section 1.   This Memorandum of Agreement (MOA) shall cover all activities in the implementation of the Establishment of the Locational Referencing System for all provincial and city roads in the Philippines (the “Project”).

Section 2.   The Project comprise of two (2) phases: Phase 1 – Conduct of Road and Bridges Inventory Survey and Phase 2 – Installation of Kilometer Posts.

Section 3.   Phase 1 shall have four (4) components:

a.      Conduct of GPS road centerline survey;
b.      Collection, consolidation and processing of road and bridge inventory data;
c.      Uploading of survey and processed data in the Roads and Bridges Inventory System (RBIS); and
d.      Conduct of capacity building activities and provision of technical assistance to LGUs in the conduct of GPS centreline and road inventory surveys, processing, uploading and updating of data in the RBIS.

 

Article II
PROJECT EXECUTION

 

Section 1.   The Project shall be implemented in conformity with the procedures and processes stipulated in the provisions of Joint Memorandum Circular No. ____ Series of 2015 (Guidelines in the Establishment of the Locational Referencing System) which is hereby made and shall form an integral part if this Agreement.

 

Article III
PROJECT IMPLEMENTATION

 

Section 1.   The Parties shall have the following roles and responsibilities:

1.1               The ROAD BOARD shall:
1.1.1          Ensure and facilitate the allocation of budget for the implementation of the Project;
1.1.2          Establish a Project Management Office (PMO) and provide the appropriate allocation of resources;

 

WHEREAS, the DILG, through its SLRF-PMO, was requested by the Road Board to conduct a Road Inventory and condition survey for the 14,956.36 kilometers of city and 31,910.24 kilometers of provincial roads;

Article IV
GENERAL PROVISIONS

 

1.4.1     The parties shall faithfully perform their respective obligations under this agreement, and shall do everything necessary, proper and convenient to carry out its intent and objectives.
1.4.2     The handling and disposition of funds herein shall be governed by the generally accepted accounting and auditing rules and procedures and related laws.
1.4.3     This Agreement shall take effect upon its execution and shall continue to take effect for the duration of the Project unless the same is sooner terminated or caused to be cancelled by any party hereto.
1.4.4     Modification Clause. This Agreement shall not be changed, modified, terminated, or discharged, in whole or in part, except by an instrument in writing signed by both parties hereto, or their respective successors or assignees.
1.4.5     Separability Clause. In case any provision in this Second Ranking Senior Debt Securities Indenture or in the Second Ranking Senior Debt Securities shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
