RESOLUTION NO. 787, s-2017

 

A RESOLUTION AUTHORIZING THE CITY MAYOR, HON. ALLAN L. RELLON, DPA, Ph.D., TO SIGN AND ACCEPT FOR AND IN BEHALF OF THE CITY GOVERNMENT OF TAGUM, THE DEED OF DONATION OF ROAD LOT OWNED BY HIJO RESOURCES CORPORATION REPRESENTED BY ITS VICE CHAIRPERSON, PRESIDENT AND CEO, ROSANNA T. FORES LOCATED AT BARANGAY MADAUM, TAGUM CITY DAVAO DEL NORTE.

 

            WHEREAS, Hijo Resources Corporation represented by its Vice Chairperson, President and CEO, Rosanna T. Fores intends to donate portion of parcel of land to the City Government of Tagum in order that the same be maintained and sustained and for purposes of future development;

 

WHEREAS, it is the concern of the City Government of Tagum to accept donations such as open spaces, road lots and community facilities to complete and maintain the development of all facilities for the use of its constituents;

 

WHEREAS, this august body deems it proper to authorize the City Mayor to sign and accept in behalf of the City Government of Tagum, the Deed of Donation of road lot covered under Transfer Certificate of Title No. 142-2017009906 containing an area of Twenty Five Thousand Nine Hundred Nine (25,909) square meters;

 

NOW THEREFORE, be it resolved by the Sangguniang Panlungsod of Tagum to authorize the City Mayor, Hon. Allan L. Rellon, DPA, Ph.D., to sign and accept for and in behalf of the City Government of Tagum, the Deed of Donation of road lot owned by Hijo Resources Corporation represented by its Vice Chairperson, President and CEO, Rosanna T. Fores located at Barangay Madaum, Tagum City Davao del Norte.

RESOLUTION NO. 787, s-2017, cont’d:

RESOLVED FURTHER, that the offices of City Environment and Natural Resources Office (CENRO), City Assessor’s Office (CAssO) and other appropriate offices shall facilitate for the processing of necessary documentation for possible real property tax exclusion.

This DEED, made and executed in Tagum City, Philippines, by and between:

 

HIJO RESOURCES CORPORATION, a corruption duly organized and existing under and by virtue of laws of the Philippines, with business address at Barangay Magdum, Tagum City, represented by its Vice Chairperson, President and CEO, ROSANNA T. FORES, of legal age, Filipino, married and a resident of Makati City, hereinafter referred to as the DONOR;

That DONOR, hereby voluntarily conveys unto the said DONEE, his executors and administrators all of the rights, title and interest which the DONOR has in the above-described real property (25,909 square meters) together with all the improvements found therein, free from all liens and encumbrances, subject to the following conditions”

 

 

1.       The area donated shall be for the sole purpose of DONEE’s construction of road right of way leading to the port, which shall hereinafter be known as DAVAO GULF GATEWAY and shall be so designated in a proper landmark;

2.       The DONEE shall, at its own expense, maintain the donated property and its immediate surroundings in a clean and safe condition, adequately illuminated, and make all the necessary maintenance and repair at all times;

3.       That the construction of the road right of way shall be initiated and developed within five ( 5 ) years from the execution of this instrument and should the same be not developed within the said period, this donation shall have no force and effect whatsoever and the ownership of the above-described property will revert back to the to the DONOR;

4.       That the road area to be donated shall be open to the public and no gate shall be installed and constructed to suppress free access by the public;

5.       That the area to be converted to uses other than herein stipulated, this donation shall be deemed revoked and the ownership shall revert back to the DONOR.

 

That the DONOR herein states, for the purpose of giving full effect and validity to this donation, that they have reserved for themselves sufficient property, in full ownership or in usufruct, which is necessary and adequate for their support in consonance with their standing in the community;

 

That the DONOR further states, that this donation is not made for the purpose of defrauding their creditors, having reserved for themselves enough and sufficient property to meet their just obligation;

 

That the DONEE hereby receives and accepts this donation made in favor of the City Government of Tagum and expresses its appreciation and gratefulness for the generosity and civic mindedness of the DONOR;

 

That the DONOR hereby acknowledges notice of acceptance of this donation by the DONEE.
