A RESOLUTION AUTHORIZING THE CITY MAYOR, HON. ALLAN L. RELLON, DPA, PhD, TO SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF TAGUM A MEMORANDUM OF AGREEMENT (MOA) WITH UNIVERSITY OF SOUTHEASTERN PHILIPPINES – TAGUM MABINI CAMPUS (USEP TMC) THROUGH ITS COLLEGE OF AGRICULTURE AND RELATED SCIENCE (CARS) REPRESENTED BY ITS PRESIDENT, DR. LOURDES C. GENERALAO PERTAINING TO THE FARM PRODUCTIVITY ENHANCEMENT FOR FARMERS AND FISHERFOLKS IN TAGUM CITY.

 

WHEREAS,  in a letter dated August 14, 2017 addressed to the Honorable Members of the Sanggunian, the Acting City Mayor, Hon. Geterito T. Gementiza, MDMG, and duly received by the Office of the Secretary to the Sanggunian on August 15, 2017, forwarded the draft Memorandum of Agreement (MOA) between the City Government of Tagum and University of Southeastern Philippines Tagum – Mabini Campus pertaining to the farm productivity enhancement for farmers and fisher folks in Tagum City, accordingly reviewed by the city Legal Officer, for appropriate action;

WHEREAS, said draft Memorandum of Agreement (MOA) was referred to the Joint Committee on Agriculture and Food and Committee on Laws, Rules, and Privileges for review and recommendation;

WHEREAS, one of the mandated functions of USEP-TMC is Extension, which aims to reach and serve rural communities to enhance farm productivity implore access to sustainable enterprise opportunities, and ensure sustainable management of environment and natural resources in the rural communities;   

 WHEREAS, USEP-TMC recognized the vital assistance of the other government institutions and non-governmental agencies and service providers in facilitating the access of organizations to income opportunities and agricultural extension services;

WHEREAS, USEP-TMC shall provide technical staff i9n different fields of Agriculture, Entrepreneurial and Business Management, Forestry, and Agricultural Engineering;

WHEREAS, it is not only the interest and desire of the LGU Tagum, but its mandate to help the beneficiaries increase their farm production and farm income for the improvement of their quality of life and likewise protect the environment;

WHEREAS, the joint committee thoroughly discussed and deliberated on the merits of the said draft Memorandum of Agreement (MOA) and as per Joint Committee Meeting Report No. 8, s-2017, dated November 8, 2017, finally recommends to support the same for being in order and within the bounds of law;

NOW THEREFORE, BE IT RESOLVED by the 7th City Council of Tagum City to authorize Hon. Allan L. Rellon, City Mayor to enter into and sign for and in behalf of the City Government of Tagum a Memorandum of Agreement (MOA) with University of Southeastern Philippines – Tagum Mabini Campus (USEP TMC) through its College of Agriculture and related Science (CARS) represented by its President, Dr. Lourdes C. Generalao pertaining to the Farm Productivity Enhancement for Farmers and Fisherfolks in Tagum City.

RESOLVED FURTHER, that the Full Text of the Memorandum of Agreement (MOA) is attached herewith;

 

 

MEMORANDUM OF AGREEMENT

 

KNOW ALL MEN BY THESE PRESENTS

 

This Memorandum of Agreement is made and entered into by and between:

The UNIVERSITY OF SOUTHEASTERN PHILIPPINES– TAGUM-MABINI CAMPUS (USEP-TMC) through its College of Agriculture and Related Science (CARS), a State Institution of Higher Learning with office address at Apokon, Tagum City, Davao del Norte, represented by its President, DR. LOURDES C. GENERALAO, herein referred to as the USEP-TMC.

 

-and-

The CITY GOVERNMENT OF TAGUM (LGU Tagum), located at JV Ayala Avenue, Apokon, Tagum City represented by its Local Chief Executive, `herein referred to as the CITY GOVERNMENT OF TAGUM (LGU Tagum).

 

WITNESSETH:

WHEREAS, one of the mandated functions of USEP-TMC is Extension, which aims to reach and serve rural communities to enhance farm productivity, improve access to sustainable enterprise opportunities, and ensure sustainable management of the environment and natural resources in the rural communities;

WHEREAS, USEP-TMC shall provide technical staff in the different fields of Agriculture, Entrepreneurial and Business Management, Forestry, and Agricultural Engineering;

WHEREAS, USEP-TMC recognized the vital assistance of the other government institutions and non-government agencies and service providers in facilitating the access of organizations to income opportunities and agricultural extension services;

WHEREAS, it is not only the interest and desire of the LGU Tagum, but its mandate to help the beneficiaries increase their farm production and farm income for the improvement of their quality of life and likewise, protect the environment;

WHEREAS, the LGU Tagum desires to continuously provide education on sustainable agriculture through comprehensive farm planning that shall generate income for the beneficiaries through the City Agriculture Office;

NOW THEREFORE, for and in consideration of the foregoing premises, USEP-TMC and the LGU Tagum hereby agree to the following covenants:

COVERAGE

The joint activities of USEP-TMC and the LGU Tagum shall cover farmers and fisherfolks of the City of Tagum.

 

 

OBLIGATIONS AND RESPONSIBILITIES OF THE PARTIES

The USEP-TMC shall:

1.       Be the Co-proponent and Co-implementer of the joint venture with LGU Tagum;

2.       Provide the necessary technical trainings and other services that have been identified in the need analysis as duly confirmed by the LGU Tagum management;

3.       Assist the LGU Tagum management in their implementation of agricultural, environment, and other related development projects;

4.       Give technical information on the conduct of the farmers’ indigenous research and development projects and endeavors;

5.       Take a lead on the joint effort with the concerned LGU Tagum personnel in the promotion of the various projects through information, education, and communication programs in the communities within and in the vicinity of the service area of the city;

6.       Use graduate and undergraduate students particularly those enrolled in extension and related subjects to assist and act as facilitators, documenters, and even speakers as the case maybe, during trainings, seminars, and workshops that maybe conducted;

7.       Prepare modules (IEC materials) for the seminars, trainings, and workshops; and

8.       Perform any other functions related to this joint project as maybe determined by the competent authorities as the need arises.

 

The LGU Tagum shall:

1.       Be the Co-proponent and Co-implementer of the joint venture, as such shall be responsible for the joint ventures day-to-day management;

2.       Provide materials and supplies needed for the conduct of activities, consultations, trainings, seminars, and workshops and other related activities;

3.       Lead in the monitoring and evaluation of the projects performed under the provisions and terms of this MOA;

4.       Inhibit itself, and all its cooperators adopted barangays, people’s organizations (PO’s), and group partners, in the manufacturing, reproduction, duplication, or sale, in any form of any of the technologies that shall be extended and made available by USEP such manufacturing, reproduction, duplication of the same be made manifest only upon written permission of, and duly approved, by USEP competent authorities.

5.       Bear responsibilities in providing the necessary counterpart fuel allocations for USEP and other vehicles which maybe used in carrying out extension work or in the vicinity of the service areas of the joint project undertaking; and

6.       Perform any other functions related to the joint venture as maybe determined by competent authorities from both parties as the need arises.

 

CREATION OF THE ADVISORY BOARD, TECHNICAL WORKING GROUP & SECRETARIAT

There shall be creation of the Advisory Board (AB), Technical Working Group (TWG) and Secretariat and shall be composed of the following personnel along with their respective task & responsibilities:

 

ADVISORY BOARD (AB) COMPOSITION:

1.       Chairperson, City Mayor
2.       Vice Chairperson, Chancellor
3.       Member,  Chairperson  of Committee on Agriculture
4.       Member, City Administrator
5.       Member, USeP Extension Head
6.       Member, City Agriculturist
7.       Member, City Veterinarian
8.       Member, City ENRO

AB Task and Responsibilities:

1.       Acts as the official decision making body for this partnership.
2.       Helps formulate strategic direction for the success of this partnership
3.       Reviews and approves policies and guidelines as recommended by the Technical Working Group.
4.       Reviews and approves the plans prepared by the Technical Working Group and the secretariat.
5.       Convene for a meeting once in every quarter or the chairperson can call for an emergency meeting as the case may be.

TECHNICAL WORKING GROUP (TWG) COMPOSITION:

The Technical Working Group shall be composed of the following:

1.)    Dean, CARS
2.)    Chairman, Dept. of Agriculture
3.)    Chairman, Dept. of Engineering
4.)    Chairman, Dept. of Forestry
5.)    Chairman, Graduate School
6.)    Research Head
7.)    Head, Office of Student Affairs
8.)    Head, Extension Division- City ENRO
9.)    Head, Extension Division- CAGRO
10.) Head, Extension Division-  CVET
11.) Head, Planning Division- CAGRO
12.) Head, AgEng Section- CAGRO
13.) Head, Farm Dev’t Section- CAGRO
14.)Head, Crops Section- CAGRO

TWG Task and Responsibilities:

1.       Prepares and formulates policies, guidelines and plans for this project
2.       Implements the approved policies, guidelines, plans and activities in accordance with the existing laws and policies
3.       Monitors the implementation of approved plans
4.       Performs other task as determined by the advisory board

SECRETARIAT COMPOSITION:

1.       Designate Head, Planning Section – CAGRO
2.       Economic Researcher – CAGRO

Secretariat Task and Responsibilities:

1.       Prepares Official communications, reports, minutes of meetings and other documents related to the project.

1.       Official record keeper of the advisory boards and technical working group.

2.       Perform other task as  determined by the advisory board

 

LINKAGES

 

LGU Tagum and USEP-TMC shall strengthen their linkages with the following agencies to fully maximize resources to effectively and efficiently deliver the goods and services to the target beneficiaries, such agencies as:

DA-RFO XI, LGUs, DENR, BFAR, and TESDA of Tagum City

 

GENERAL PROVISIONS

 

MODIFICATION.     No modification of any part of this Agreement shall be made unless agreed upon by both parties and written in a Supplemental Memorandum of Agreement.

RESCISSION.          Failure of the USEP-TMC to meet the purpose of this agreement and any violation of the provisions of this Agreement shall give the other party the right to extrajudicially demand rescission of this Agreement with the effect of its immediate termination upon receipt of the demand letter of the guilty party.

 

EFFECTIVITY

 

This agreement shall take effect upon signing by all parties concerned and shall remain in force without prejudice to extension/renewal for a number of years as maybe determined or deemed necessary by both parties unless sooner terminated/modified/amended/rebuked by either or both parties to terminate/modify/amend/rebuke within at least 2 months prior to execution of the same.
