RESOLUTION NO. 798, s-2017

 

“A RESOLUTION AUTHORIZING THE CITY MAYOR, HON. ALLAN. L. RELLON, DPA, Ph.D, TO ENTER INTO AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF TAGUM A MEMORANDUM OF AGREEMENT (MOA) WITH THE DEPARTMENT OF HEALTH REGIONAL OFFICE XI  FOR THE IMPLEMENTATION OF THE INTEGRATED CLINIC INFORMATION SYSTEM”.

 

WHEREAS, in a letter dated February 2, 2017 addressed to the Honorable Members of the Sanggunian, the City Mayor, Hon. Allan L. Rellon, DPA, PhD, forwarded the draft Memorandum of Agreement (MOA) between the City Government of Tagum and the Department of Health Regional Office XI, for urgent and appropriate action;

WHEREAS, accompanying the letter was a certification from the City Legal Officer, Atty. Randy E. De Gala, that said draft Memorandum of Agreement is in order and in accordance with the governing rules and regulations;

WHEREAS, it is embodied in the Implementing Rules and Regulations of the Local Government Code of 1991, Article 25, Rule V, that the Local Government Unit (LGU) shall, in addition to their existing functions and responsibilities, provide basic services and facilities devolved to them covering, but not limited to (1) implementation of programs and projects on primary health care, maternal and child care, and communicable and non-communicable disease control services and, (2) access to secondary and tertiary health services;

WHEREAS, Republic Act 3573, otherwise known as “Law of Reporting Communicable Diseases” requires all individuals and health facilities to report notifiable diseases to local and national health authorities;

WHEREAS, information and communication technologies is an identified essential tool to improve health care, to increase the level of engagement of each individual in their own care, to provide quality services, to support sustainable health care financing system, practice good governance and promote universal access for all Filipinos;

WHEREAS, one of the technology solutions developed by the DOH through its Bureaus was the Integrated Clinic Information System, a model for electronic medical records and health information system primary care facilities that complements the PHIC requirements for benefit packages through DOH reporting necessities including national health data standards;

WHEREAS, in order to implement a better health outcomes, responsive health systems and data gathering for decision making it necessary to pass a resolution pertaining thereof;

NOW THEREFORE, be it resolved by the Sangguniang Panlungsod of Tagum to authorize the City Mayor, Hon. Allan L. Rellon, DPA, PhD, to enter into and in behalf of the City Government the Memorandum (MOA) with the Department of Health Regional Office XI for the implementation of the Integrated Clinic Information System.

RESOLVED FURTHER, that the full text of the Memorandum of Agreement shall be as follows:

 

 

MEMORANDUM OF AGREEMENT
Implementation of the Integrated Clinic Information System (iClinicSys)

 

 

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA), made and entered into by and between:

The Department Of Health, Regional Office XI (DOH-RO XI), a government agency of the Republic of the Philippines created pursuant to Executive Order 94 s. 1947 and Executive Order No. 102 s. 1999, with principal office address at J.P Laurel Avenue, Davao City herein represented by ABDULLAH B. DUMAMA, JR., MD, MPA, CESO III, Assistant Secretary of Health – Mindanao Cluster and Regional Director, hereinafter referred to as the DOH RO XI;

-and-

The City Government of Tagum, a Local Government Unit (LGU) established and existing under the laws and regulations of the Republic of the Philippines, with principal office address at Tagum City, Davao del Norte, represented by HON. ALLAN L. RELLON as City Mayor, hereinafter referred to as the LGU.

WITNESSETH THAT:           

WHEREAS, the Department of Health by virtue of its mandate, holds the over-all technical authority in health with three major roles of leadership and regulator in health; enabler and capacity builder; and administrator of special health services;

WHEREAS, Republic Act 7160 otherwise known as the 1991 Local Government Code mandates the devolution of the delivery of health services and facilities as one of the basic functions and responsibilities of all Local Government Units or LGUs at all levels;

WHEREAS, Republic Act 3573 otherwise known as “Law of Reporting Communicable Diseases” requires all individuals and health facilities to report notifiable diseases to local and national health authorities;

WHEREAS, DOH Administrative Order No. 2011-0010 “Implementing Procedures and Guidelines in Reporting Field Health Services Data to the DOH Central Office,” provide guidelines and procedures on reporting filed health services data and that said order applies to all DOH Central Offices, Regional Health Offices, DOH retained and Local Government Units with health facilities such as Provincial/City/Municipal/District/Barangay Health Offices;

WHEREAS, information and communication technologies is an identified essential tool to improve health care, to increase the level of engagement of each individual in their own care, to provide quality services, to support sustainable health care financing system, practice good governance and promote universal access for all Filipinos;

WHEREAS, the Philippine eHealth Strategic Framework and Plan 2014-2020 which provides sense of direction and outlines measurable goals for the National eHealth Program or the use of information and communication technologies in health has the vision that by 2020, “An ICT-enabled Philippine Health System towards better and equitable access to quality health care services, and easier access to secure real time and quality health data and information for evidenced-based decision making” is achieved;

WHEREAS, the Philippine Health Agenda for 2016-2020 under its strategy ‘ACHIEVE’ for financial protection, better health outcomes and responsive health systems will invest in eHealth and data for decision making, thus, the health sector shall continue to ensure appropriate utilization of ICTs to improve health care, to increase the level of engagement of each individual in their own care, to provide quality services, to support sustainable health care financing system, practice good governance and promote universal access for all Filipinos;

WHEREAS, one of the technology solution developed by DOH through Epidemiology Bureau (EB), Disease Prevention and Control Bureau (DPCB) and Knowledge Management and Information Technology Service (KMITS) which implemented at point of care is the iClinicSys, a reference model for electronic medical records and health information system for primary care facilities that satisfies Philippine Health Insurance Corporation requirements for benefit packages through capitation and DOH reporting necessities including national health data standards;

WHEREAS, iClinicSys software is provided free to interested primary health care facilities including the training and technical support if needed subject to compliance to health information interoperable standards, acceptability of ICT infrastructure in place and commitment for primary care facility management and operation support including availability of at least two (2) iCilicSys designated encoders;

WHEREAS, the LGU desires to implement and use the iClinicSys as an electronic medical record and health information system which they will use for the health services to help manage the patient demographics, medical histories, diagnoses, treatments, medications, laboratory requests and results and generate the required data for their use and also submission to DOH and PhilHealth;

NOW THEREFORE, for and in consideration of the foregoing premises and the covenant hereunder, the parties have mutually agreed to enter into this Agreement under the following terms and conditions:

 

I.              Roles and Responsibilities of LGU

1.       Responsible for the provision and maintenance of necessary ICT resources r required to implement the system;
2.       Designate at least two (2) personnel that will be responsible in promptly entering and uploading the data, manage the system and backup data;
3.       Ensure the validity and/or integrity and security of data to be entered in the system.
4.       Ensure the confidentiality of the data stored in the system;
5.       Submit the required data and statistical reports to the DOH and PhilHealth on a regular basis;
6.       Agree to standards compliance PHIE data privacy;
7.       The LGU agrees that they shall comply with all required or applicable Philippine governing laws, policies, ordinances, memoranda and other issuances or mandates shall be liable  to the iClinicSys. Further, the LGU shall be liable to any loss or damage to include reasonable attorney’s fee that may be sustained by reason of the failure of the LGU to comply with such laws, policies, ordinances, memoranda and other issuances or mandates; and
8.       The LGU shall not disclose, release, distribute, disseminate, or sell the iClinicSys or allow others to obtain such copies from the system for any purpose other than that permitted by the DOH and/or as required by law.

I.              Roles and Responsibilities of DOH through its REGIONAL OFFICES

1.       Assist the LGU in the installation and access to the iClinicSys by providing resources such as the system installer, version updates and soft copy of software operations manual and system security encryption;
2.       Provide training for technical staff of the LGU on how to use and manage the iClinicSys;
3.       Provide technical assistance in case there is a need to troubleshoot the system;
4.       Secure any data that may be required for information exchange if allowed;
5.       Conduct monitoring and evaluation on the performance of the system;
6.       The DOH through its regional office agrees that they shall comply with all required or applicable Philippine governing laws, policies, ordinances, memoranda and other issuances or mandates related to the iClinicSys. Further, the DOH through its regional office shall be liable to any loss or damage, to include reasonable attorney’s fee that may be sustained by reason of the failure of the DOH through its regional office to comply with such laws, policies, ordinances, memoranda and other issuances or mandates; and
7.       In case system installer, version updates, soft copy of software operations manual and system security encryption failure the Department of Health through its Regional Office shall be responsible for the same.

II.            Responsibility of both parties

Both parties hereby unconditionally and irrevocably agree to preserve and maintain with utmost confidence all Confidential Information, use the said information in the performance of services in accordance to the agreement and segregate the “Confidential Information accordingly respective of its rightful owners.

III.           TERMS/Conditions:

a)     All data/information lodged in the jurisdiction of the LGU under its supervision, care and/or custody are rightly owned by the LGU, even after this MOA has been terminated or expired.
b)     All confidential health information or medical records information that are exchanged among the parties shall remain the property of the LGU.
c)      Other policies on Confidential Health Information shall conform to Republic Act No. 10173 or the “Data Privacy Act of 2012,” and its implementing rules and regulations.

IV.           Termination

At any time during the effectivity of this MOA, any of the parties may terminate and same upon written notice to that effect at least thirty (30) days prior to the date of such termination. Activities in progress at the time of termination of this MOA shall be permitted to coincide as planned unless otherwise agreed.

This MOA shall be effective within one (1) year which shall take effect on January 3, 2017 until December 31, 2017.
